By accessing or using the website located at indiantraildeckandfence.com (the "Site"), or by engaging Indian Trail Deck & Fence ("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Site or engage our services.
These Terms apply to all visitors to the Site and to all customers who enter into a service agreement with Indian Trail Deck & Fence. We reserve the right to update these Terms at any time. Updates take effect when posted to the Site, and continued use of the Site or our services constitutes acceptance of the revised Terms.
Indian Trail Deck & Fence provides residential and commercial outdoor construction services, including but not limited to custom deck design and build, composite deck installation, pressure-treated wood deck construction, cedar wood deck construction, deck repair and replacement, deck staining and sealing, pool deck construction, vinyl fence installation, wood and privacy fence installation, screened-in porches, covered decks and patio covers, pergola installation, outdoor kitchen decks, multi-level decks, and deck railing installation.
All services are provided to properties located within our stated service areas. We reserve the right to decline any project at our discretion, including projects outside our service area or those that do not meet our operational requirements.
Estimates provided by Indian Trail Deck & Fence are based on information available at the time of the site visit and the scope of work described by the customer. All estimates are provided in writing before any work begins. An estimate is not a guaranteed final price.
Final pricing may change if the scope of work changes, if unforeseen site conditions are discovered during construction (such as hidden rot, inadequate existing structure, or permit requirements that alter the design), or if the customer requests changes after a contract has been signed. Any material changes to scope or cost will be communicated to you in writing before additional work proceeds.
Estimates are valid for 30 days from the date of issuance. Material prices are subject to market fluctuation, and we reserve the right to revise an estimate that is accepted more than 30 days after it was issued.
Project start dates are estimates and may be subject to change due to weather conditions, permit processing timelines, material availability, or scheduling conflicts. We will communicate any significant delays to you as soon as they are known.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after materials have been ordered or fabricated may be subject to restocking or cancellation fees, which will be outlined in your written service agreement. Deposit amounts and refund policies will be specified in your individual contract.
We reserve the right to suspend or terminate a project if site conditions are unsafe, if payment obligations are not met, or if the customer materially breaches the terms of the service agreement.
Payment terms are established in your written service agreement prior to the start of any work. A deposit is typically required before materials are ordered or work begins. The remaining balance is due upon completion of the project or as outlined in the payment schedule in your contract.
Accepted payment methods will be specified in your service agreement. Late payments may be subject to a late fee as described in your contract. In the event of non-payment, Indian Trail Deck & Fence reserves the right to pursue collection through appropriate legal channels, including the filing of a mechanics lien against the property where permitted by North Carolina law.
Indian Trail Deck & Fence will obtain required building permits from the applicable local authority (typically Union County Building and Development Services) as part of the project. Permit fees, where applicable, will be reflected in your written estimate.
If your property is governed by a homeowners association (HOA), it is the responsibility of the property owner to obtain any required HOA approvals before construction begins. We will assist by providing drawings and documentation as requested, but we are not responsible for delays or project modifications required by HOA decisions made after a contract is signed.
Indian Trail Deck & Fence warrants that all work will be performed in a professional and workmanlike manner, in compliance with applicable building codes and permit requirements, using materials as specified in the service agreement. Specific warranty terms, including duration and coverage, will be stated in your written service agreement.
Manufacturer warranties on materials (such as composite decking or railing products) are governed by the respective manufacturer's terms and are separate from any workmanship warranty we provide. We will assist in connecting you with the appropriate manufacturer contact if a materials claim arises.
Our warranties do not cover damage caused by misuse, neglect, failure to follow maintenance guidelines, acts of nature, or modifications made by anyone other thanIndian Trail Deck & Fence after project completion.
EXCEPT AS EXPRESSLY PROVIDED IN YOUR WRITTEN SERVICE AGREEMENT, ALL SERVICES AND MATERIALS ARE PROVIDED ON AN "AS IS" BASIS, AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
To the maximum extent permitted by applicable law, Indian Trail Deck & Fence shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or related to our services or your use of this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific project giving rise to that claim. This limitation applies regardless of the theory of liability - contract, tort, strict liability, or otherwise.
You agree to provide accurate and complete information about your property, including any known site conditions, underground utilities, existing structures, and HOA requirements. Before work begins, you are responsible for marking the location of any underground utilities not covered by 811 locating services.
You agree to maintain a safe and accessible work site during the project, including keeping people and animals away from active construction areas. Failure to provide reasonable site access may result in project delays and could affect your warranty coverage.
We encourage you to contact us directly if you have a concern about any aspect of our work or services. We are committed to resolving disputes promptly and fairly.
If a dispute cannot be resolved through direct communication, the parties agree to attempt to resolve the dispute through non-binding mediation before pursuing litigation. The cost of mediation shall be shared equally by both parties unless otherwise agreed in writing.
Any legal action arising from these Terms or our services shall be brought in the courts of North Carolina, and both parties consent to the personal jurisdiction of those courts.
These Terms and Conditions, and any disputes arising from them or from any service agreement with Indian Trail Deck & Fence, shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
All content on this Site, including text, images, and design, is the property ofIndian Trail Deck & Fence or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this Site for commercial purposes without our express written permission.
